Ernest Booker, 45, of Ashland was indicted by the Boyd County Grand Jury on Wednesday on 44 counts of possession of matter portraying a sexual performance by a minor, according to court documents. Booker is currently imprisoned after being convicted in 2016 on 12 counts of use of a minor in a sexual performance and third-degree rape, said court documents. Booker has appealed his conviction and during the appeal investigation, authorities have allegedly discovered evidence that led to the indictment of Booker on 15 new charges in April, and 44 new charges last week, said authorities.

CATLETTSBURG – An imprisoned man currently appealing his conviction for the rape of a minor was indicted on 44 new counts of child porn on Wednesday after investigators discovered new evidence.

Ernest Booker, 45, of Ashland was indicted by the Boyd County Grand Jury on Wednesday on counts 29 – 72 of possession of matter portraying a sexual performance by a minor, said court documents.

Booker was convicted in March 2016 by special Judge Johnny Ray Harris in Boyd County Circuit Court on the charge of third-degree rape and 12 counts of use of a minor in a sexual performance, said court documents. Booker was sentenced to 15 years in prison, however his case is under review by the Court of Appeals.

Special prosecutor Derrick Willis said that during the appeal process officers have reinvestigated the case and during that investigation they discovered “more items that would be deemed as child pornography.”

The indictment said that Booker “had in his possession or control, matter which visually depicts actual sexual performances by a minor person.”

The superseding indictment will be included in the underlying case that was remanded to the court on appeal, said Willis.

Booker was also served with an indictment warrant in April for 15 new charges of possession of matter portraying a minor in a sexual performance after investigators discovered new evidence, said Willis.

Booker is currently facing a total of 72 sex offense charges, including charges of matter portraying a sexual performance of a minor, third degree rape, and use of a minor in a sexual performance, said court documents.

Booker was previously convicted after he falsified his age and name and engaged in a relationship with a 15-year-old girl and impregnated the girl when she was 16, according to Willis in a statement in 2016. He was sentenced to 10 years in a state penitentiary on 12 counts of use of a minor in a sexual performance and five years for rape.
