2 indicted in break-ins

Catlettsburg A Boyd County grand jury on Tuesday indicted a man and woman in connection with a pair of residential break-ins, one of which authorities characterized as a home invasion.

Eric C. Nelson, 20, and Taylin Secord, 18, both were charged with two counts of second-degree burglary. Nelson was also charged with first-degree wanton endangerment and first-degree fleeing or evading.

Both defendants also were charged with several traffic offenses. All told, the two were indicted on 15 charges.

The break-ins occurred Nov. 4 and Nov. 11 at residences on Cannonsburg Road and Ponderosa Drive. In one of the incidents — it was not immediately clear which — the homeowner was in another room while the pair allegedly ransacked the house.

Boyd Assistant Commonwealth’s Attorney Scott Reese said he wasn’t sure what the relationship between the defendants was.

Both incidents are being investigated by the Boyd County Sheriff’s Department.

In an unrelated case, the grand jury on Tuesday also handed up a superseding indictment against a Boyd County man arrested last week on multiple sodomy charges.

Robert R. Davis, 39, of Rush, was initially charged with 10 counts of first-degree sodomy and 49 counts of second-degree sodomy. However, the amended indictment charges him with one count of first-degree sodomy and 48 counts of second-degree sodomy.

Reese said the case was presented again to the grand jury after a review of records indicated that there was only one alleged incident that involved forcible compulsion, a necessary element to prove first-degree sodomy.

First-degree sodomy can be either a Class A or Class B felony, depending on the age of the victim. In Davis’ case, it is a Class B felony that carries a prison sentence of 10 to 20 years.

Third-degree sodomy is a Class D felony punishable by a prison sentence of one to five years.

The charges against Davis stem from a Kentucky State Police investigation and involve a male victim who is not related to the defendant.

Davis is scheduled to be arraigned Friday before Boyd Circuit Judge C. David Hagerman.

A grand jury indictment is a formal accusation of a crime and does not establish guilt.

Other indicted Tuesday by the grand jury were:

‰Adam Lovin, 23, on one count of theft by unlawful taking over $300 and one count of receiving stolen property over $300.

‰Gideon Page, 26, on one count of theft by unlawful taking over $300 and one count of receiving stolen property over $300.

‰Amanda R. Rice, 26, on one count of criminal possession of a forged prescription.

‰Ricky A. Mills, 21, on one count of theft by failure to make required disposition.

‰Stacy Dixon, 39, on one count of first-degree forgery.

‰Jonathan Gerald Clark, 26, on one count of first-degree sodomy.

‰Christopher L. Tebelman, 18, on one count of second-degree rape and one count of unlawful transaction with a minor.

‰Victor A. Bentley, 21, on three counts of first-degree wanton endangerment, one count of third-degree criminal trespassing, one count of first degree fleeing or evading and one count of first-degree persistent felony offender.

‰Johnny R. Branham, 23, on six counts of second-degree criminal possession of a forged instrument.

‰Jonathan A. Enyart, 18, on one count of second-degree robbery.

‰Melissa A. McCleod, 25, on one count of first-degree bail-jumping.
