Man charged with 59 counts of sodomy

Crimes allegedly occurred when victim was a juvenile

RUSH Kentucky State Police on Tuesday arrested a Boyd County man on sex crime charges that could result in him being sentenced to nearly 500 years in prison.

Robert R. Davis, 39, of Rush, was lodged in the Boyd County Detention Center on 10 counts of first-degree sodomy and 49 counts of third-degree sodomy, according to a news release from the Ashland KSP said.

The charges all involve crimes that Davis allegedly committed against the same male victim, said Trooper Elliott Gollihue, spokesman for the Ashland post.

The more serious charges of first-degree sodomy were for incidents that allegedly occurred when the victim was a juvenile, Gollihue said. The third-degree sodomy charges were for crimes allegedly committed against the victim after he had reached the age when he could legally consent to sexual activity.

First-degree sodomy can be either a Class A or a Class B felony. In Davis’ case, the charges are Class B felonies, each of which carries a prison sentence of 10 to 20 years, Gollihue said.

Third-degree sodomy is a Class D felony punishable by a prison sentence of one to five years.

Gollihue said Davis’ alleged victim was “an acquaintance, not a family member.” The alleged offenses occurred over “an extended period,” he said, but he could no give a more precise time frame.

The alleged victim came forward to the KSP in May, Gollihue said. Evidence against Davis was presented to a Boyd County grand jury, which handed up indictments against Davis on Monday, he said.

A grand jury indictment is a formal accusation of a crime and does not establish guilt.

Davis was arrested at his home without incident by Trooper Shane Goodall. The case remains under investigation by Trooper Aaron Martin.

Davis is being held under $100,000 cash bond.
