Man accused of theft, chase among 28 indicted

CATLETTSBURG A man accused of stealing a car in Ashland, then leading police on a chase before crashing the vehicle in Catlettsburg, was among 28 defendants indicted Friday by a Boyd County grand jury.

David E. Nichols, 52, of Catlettsburg, was charged with felony theft, fleeing or evading police and first-degree wanton endangerment.

The charges stem from an incident that occurred July 21. According to the Ashland Police Department, Nichols and another man, Timothy Ward, took off in a 2001 Ford Mustang that Deborah Thomas of Ashland had just driven to her grandmother’s house on Herman Avenue.

A witness who saw two men get into the car and take off said the driver appeared to be intoxicated.

A description of the stolen vehicle was broadcast to area law enforcement agencies. A Catlettsburg police officer spotted the car and pursued it for a short distance before it crashed into a utility pole near the intersection of U.S. 23 and 34th Street.

Nichols and Ward were both ejected from the vehicle and were taken by helicopter to Cabell Huntington Hospital.

A grand jury indictment is a formal accusation of a crime and does not establish guilt.

Others indicted Friday by the grand jury were:

— Linn D. Miller, 47, of Ashland, charged with two counts of drug possession and one count of public intoxication.

— Warren L. Pollard, 22, of Ashland, charged with one count of second-degree burglary and one count of second-degree persistent felony offender.

— Rachel L. Rice, 29, of Ashland, charged with one count of drug possession and one count of second-degree persistent felony offender.

— Michael D. Boyd, 32, of Ashland, charged with one count of first-degree drug possession and one count of first-degree persistent felony offender.

— Larry M. Rowe, 28, of Ashland, charged with one count of first-degree criminal mischief.

— Gary R. Rowe, 29, of Ashland, charged with one count of first-degree criminal mischief.

— Christopher T. Bocook, 33, of Catlettsburg, charged with one count of receiving stolen property.

— David Ray Spradlin, 52, of Ashland, charged with one count of first-degree persistent felony offender.

— David L. Dupree, 28, of Catlettsburg, charged with one count of third-offense driving under the influence, two counts of drug possession, one count of possession of drug paraphernalia and one count of receiving stolen property.

— Linda F. McKenzie, 26, of Ashland, charged with one count of second-degree forgery and one count of fraudulent use of a credit card.

— Christopher L. McKenzie, 26, of Ashland, charged with one count of drug possession and one count of driving under the influence.

— Sherry R. Logiudice, 41, of Westwood, charged with one count of drug possession and one count of driving on a suspended license.

— Jennifer L. Brammer, 26, of Ironton, charged with one count of first-degree promoting contraband and one count of second-degree persistent felony offender.

— Jody L. Gamble, 33, of Ashland, charged with two counts of drug trafficking and one count of possession of drug paraphernalia.

— Timothy W. Lake Jr., 30, of Ashland, charged with two counts of drug trafficking, one count of possession of drug paraphernalia and one count of first-degree persistent felony offender.

— Kristen M. Mowery, 19, of Ironton, charged with one count of felony theft.

— Regina A. Clark, 28, of Jacksonville, Fla., charged with one count of possession of a forged prescription.

— Robert P. Green, 33, of Russell, charged with one count of fourth-offense DUI, two counts of drug possession and one count of driving on a suspended license.

— James Lee Hamilton, 19, of Coal Grove, charged with one count of first-degree criminal possession of a forged instrument.

— Paul N. Jarvis, 34, of Ashland, charged with one count of drug trafficking and one count of possession of drug paraphernalia.

— Michael D. Price, 38, of Ashland, charged with one count of second-degree burglary and one count of second-degree persistent felony offender.

— Melannie E. Musick, 38, of Westwood, charged with one count of receiving stolen property and one count of second-degree persistent felony offender.

— James A. Curry, 21, of Huntington, charged with one count of drug trafficking.

— Andrew M. Banfi IV, 20, of Ceredo, charged with one count of drug trafficking.

— Chester D. Napier, 37, of Ashland, charged with one count of theft.

— Jamie L. Pack, 29, of Ashland, charged with one count of theft.
